Wedding in Laos


Lao Weddings are known as a South East Asian family event as we have our own unique and old traditional that have followed our ancestors for thousands of years. Last weekend I had the opportunity to go to a traditional wedding that Lao people attend. Travel Indochina Laos
A Lao Wedding is one event that busiest time for both families as the groom and bride need to prepare for at least two weeks or up to a month depending on the situation of the families. Both families would come together to talk about when is good time for them to have the wedding — this also includes the magic man. It is his job to come up with a good date as per the Buddhist calendar and animism day as well.

After a date is set, both families would need to make a list of the guests that they would like to invite — not only friends but also parents, uncles and aunts along with brothers or sisters. Even their close friends of friends would make the list of the people that they will invite. Travel to Laos
In Laos we use one invitation for two people, so for a regular wedding about 500 – 1,500 invitation cards depending on how big the wedding is. The groom and bride will give the invitation cards out about one week or latest 3 days prior the wedding date.
The groom and bride would also look for some place for the all-important pre-wedding photo shooting. Some couples like to do this in the studio but others like to do outside like at the National Museum, their favourite temple or even at the stadium where they can get better scenery.
20 Wedding in laos
A traditional Laos wedding is usually held at the bride’s family home. The wedding ceremony takes place can either be in the morning or afternoon. In the past it was always in the morning which was believed to be best time for a joyful celebration such as wedding ceremony to take place, whereas the afternoon is considered the time for sad ceremonies like cremations. However, with modern lifestyles convenience has become more important so the time doesn’t really matter any more. Generally, 10:00am and 4:00pm are usually considered the best times because guests are invited to have lunch or dinner after the official ceremony is finished.
The wedding preparations start with the sou khor (bride-price negotiation) procession.
The bride-price is usually money and gold, but it can be anything valuable. Traditionally this is asked by the bride's parents as a refund for the breast milk that has been fed to the bride since she was born (literally translated from Lao). How much? depends on the family social status of both sides. Nowadays many parents don't ask for anything so long that their daughter is happy.
Engagement
Engagement is not that common in Laos. Some couples get engaged before their wedding while many others don't bother with the engagement at all. There are no set rules really, especially nowadays when life style of many Lao has changed.
When both sides negotiate and agree on the bride-price and all other details then they set the wedding date.
Traditionally, the wedding date has to be on a good day in lunar calendar, so parents of either or both sides usually consult elders or senior ex-monks, who have good knowledge of Lao custom and tradition, before the wedding date is set. One thing most Lao knows is that the wedding is not supposed to take place during the three months khao phansa (Buddhist Lent, late July - late October).
Today this procession has been slightly changed to suit modern lifestyles and sometimes the couple agrees on most of the details (including the bride-price) and they set the date to suit their busy lives. When it comes close to the wedding day, this sou khor procession is organised just for the sake of Lao custom or tradition.
The night before the Laos wedding takes place, an informal ceremony is held at the bride-to-be’s home, and sometimes the groom holds the same ceremony at his place as well. This is call an oun dong (wedding or marriage warming) and it only involves close friends and relatives who come to help with wedding preparations as well as to eat and drink. The things to prepare include pha khoun (handmade marigold pyramid made of banana leaves), food for the big day and the new couple’s bedroom. In this room tradition demands the bed must be made by the mother of the bride or an older female who has a good family (with a good husband and good children and who is not divorced, or a widow).
On the big day, the bride is dressed with a traditional Lao silk sinh (Lao skirt), and silk blouse, and has her hair tied up in a special way with gold decoration. This ensemble is finished off with a gold necklace, bracelets, earrings and a bell.
The groom also gets dressed up usually with white or cream coloured silk shirt and a traditional silk salong (a pair of baggy pants). Sometimes grooms wear normal pants and suits as some find salongs uncomfortable.
Traditionally, on the wedding day a small baci (also spelt basi) or sou khuan (a spirit enhancing) ceremony is held concurrently in both the bride’s house and the groom’s prior to the formal wedding. Now many omit this custom, especially in urban areas where Lao customs and traditions are fading.
Once the small baci is finished, a convoy of the groom is sent ahead to give the bride-price to the bride’s parents. The bride-price could be gold or money. The convoy usually consists of few older men and women, who could be the groom’s parents and relatives who are good and know a lot about Lao customs and traditions. The leader of the convoy would politely say something like “we come with horses, buffaloes, cows, a pile of silver and gold to give to you in exchange for our son coming to live with you” or something similar. While this exchange is taking place the groom’s group is formed and waits somewhere nearby.

When the procession is finished, the groom’s group is informed and they begin to walk to the bride’s home, playing musical instruments, singing and dancing along the way. Everybody is laughing, cheering and smiling in the most joyful way. The groom walks under an umbrella carried by his friend. This part of the Laos wedding is supposed to be really fun to join. This procession is called hae keuy.
When they arrive at the bride’s house, the groom and his party are met by the bride's relatives where a silver door and a gold door are set up and closed. These doors are just lines of silver and gold bells stretched across the door way to prevent the groom entering before he is granted permission. The groom will be allowed to go inside only after he drinks with the bride’s relatives and pays them to open the doors and after their customary questions such as: “Where did you come from? What did you come here for? What did you bring with you?” etc. are answered. So… extensive bargaining, questioning and drinking takes place here which is another fun part of the Laos wedding.

Going along Cambodia, it is frequent to catch a Buddhism pagoda; a pagoda is not only the religious but also cultural and political centre of the community living around. Moreover, most festivals in Cambodia are associated with Buddhist rituals. For example, the Pchum Ben (take place in September and October) is a day for memorizing departed ancestors; Meak Bochea (in January or February) is for commemorating the last sermon of Buddha. CAMBODIAN LIFESTYLE
Lifestyle of people living along Mekong River has both common traits of Southeast Asia countries and peculiarities of its own. These Cambodians have distinguished ways of working, living and behaving which makes the unique beauty of Cambodia.
Mekong River – the aortic of Cambodians have brought Cambodians with abundant source of water as well as marine. As a result, most of population habiting along Mekong River lives on fishing and farming. Although being endowed with favorable natural conditions, Cambodians have tradition of hard-working. Regularly, Cambodian peasants leave theirs for farm house before the sunrise and come back home after the sunset. Modern life has made little impact on Cambodians’ life; they still follow traditional ways of farming with traditional techniques. For example, instead of using agrimotor, Cambodian peasants lead their water buffalo to the fields. The main agricultural product of Cambodians living along Mekong River is wet rice which is also their main food. Rhythm of Cambodian life goes along with rhythm of season. In rainy season, Cambodians plant wet rice and fish on the river or lake. After rainy season, Cambodians often plant palm trees to make palm sugar. Cambodians community living along Mekong River love working and respect their labor outcomes.
Most of Cambodians live in the village and their lives are strong attached with the village from birth to death. All major events like birth, marriage, and death occur within the villages. As a result, they are quite shy but very warm and friendly. Families in Cambodia tend to be extended family. Sometimes, there are up to three or four generations living under a same roof. Cambodians often give birth to many children (often 3-5) because they prefer a big family. Family members in Cambodia share close connection.
Overall, Cambodian society is quite conservative; and most of activities are centered around the family and religion. Mekong River plays an important role in their life. It is not only the source of life but also their pride and satisfaction.

Things to do in Luang Prabang Laos


For reasons that are soon become apparent, Luang Prabang is often described as the 'Jewel in Laos Crown'. Even though the town is well and truly on the tourist trail, it has nonetheless managed to preserve its natural splendor and inherent charm, exuding a missed-out-on-modernization vibe. The majority of the city's sights can be reached on foot, so getting a map and making your way to the many temples (33 to be exact) is a good way to soak up the surroundings and observe the way of the Lao people, and the large monk community. The wonder of the ancient temples is apparent at first glance; the gentle and unassuming nature of the locals, given the chance, will also leave a lasting impression.

Alms Giving is held at 4 or 5am daily morning. When attending this special ceremony, everyone brings food, which is prepared and laid carefully on a silver tray, or in rattan basket, sits on the roadside and wait for silent lines of saffron-clad monks walk down the streets of Luang Prabang to collect alms. Take a short driving outside the city, guests will have a chance to visit Elephant Camp near River bank and learn how to control, ride an Asian Elephant. Other activities can be combine such as trekking, visit Waterfall, kayaking, or some mahout course with Camp’s staff.

Baci ceremony
Baci, an authentic ceremony of well wishing, dating back to the times before Buddhism, was widely accepted as the main religion of Lao people. During the ceremony, white cotton threads representing 32 benevolent spirits are symbolically tied around the wrist of the attendants. Locals believe that these Khouan work to protect the people from illness, sadness and the general malaise of everyday, modern life. The blessing is overseen by a Mo Phon (like a Master of Ceremonies) who ensures the Khouan are correctly wound and aligned. After the ceremony, guests are invited to enjoy a special Lao meal comprising many renowned local dishes.
The temples of Luang Prabang
Before the Black Flag attacks of 1887 there were 60-plus temples in Luang Prabang, but many were destroyed following the upheaval that followed. Presently, the city has 34 wats which are now protected by the city's UNESCO status and house more than 1,000 monks. Cần xem xét lại thủ tục cấp giấy phép lao động cho người nước ngoài

Việc quản lý lao động là người nước ngoài, cần được thống nhất giữa các cơ quan trong việc cấp các giấy tờ như giấy khám sức khỏe, visa, giấy chứng nhận đã làm công tác quản lý ở nước bản địa. (yêu cầu người nước ngoài phải có giấy khám sức khỏe ở bệnh viện Việt Nam; hay yêu cầu người nước ngoài đang ở Việt Nam gia hạn giấy phép lao động, phải về nước xin xác nhận làm mất thời gian và chi phí cho nhà đầu tư).

 Theo công văn Số: 1245/SLĐTBXH - LĐVL ngày 15 tháng 7 năm 2015 của Sở Lao động thương binh và xã hội về việc triển khai kết quả khảo sát doanh nghiệp tháng 6/2015: Thủ tục làm giấy phép lao động nhanh nhất
a) Về đề nghị cần thống nhất giữa các cơ quan trong việc cấp các giấy tờ như giấy khám sức khỏe, giấy chứng nhận đã làm công tác quản lý ở nước bản địa.
Theo quy định tại Nghị định số 102//2013/NĐ-CP ngày 05/9/2013 của Chính phủ quy định chi tiết thi hành một số điều của Bộ luật Lao động về lao động nước ngoài làm việc tại Việt Nam; Thông tư số 03/2014/TT-BLĐTBXH ngày 20/01/2014 hướng dẫn thi hành một số điều của Nghị định số 102//2013/NĐ-CP ngày 05/9/2013:
- Giấy chứng nhận sức khỏe được cấp ở nước ngoài hoặc ở Việt Nam theo quy định của Bộ Y tế.
- Văn bản xác nhận là nhà quản lý, giám đốc điều hành là một trong những giấy tờ sau:
+ Giấy tờ chứng minh là nhà quản lý hoặc giám đốc điều hành gồm: Giấy phép lao động hoặc hợp đồng lao động hoặc quyết định bổ nhiệm có xác định người lao động nước ngoài đó đã làm việc ở vị trí quản lý, giám đốc điều hành.

+ Văn bản xác nhận là nhà quản lý, giám đốc điều hành do cơ quan, tổ chức, doanh nghiệp mà người lao động nước ngoài đã từng làm việc xác nhận.
Các giấy tờ nêu trên là 01 bản chính hoặc 01 bản sao; nếu bằng tiếng nước ngoài phải hợp pháp hóa lãnh sự (trừ trường hợp được miễn hợp pháp hóa lãnh sự theo điều ước quốc tế mà Việt Nam và nước ngoài liên quan đều là thành viên hoặc theo nguyên tắc có đi có lại hoặc theo quy định của pháp luật) và dịch ra tiếng Việt, chứng thực theo quy định của pháp luật Việt Nam.
Quy định đối với giấy chứng nhận sức khỏe, văn bản xác nhận là nhà quản lý, giám đốc điều hành nêu trên được áp dụng thống nhất trên toàn quốc; là căn cứ để cơ quan có thẩm quyền cấp giấy phép lao động thẩm định khi xem xét hồ sơ đề nghị cấp giấy phép lao động.
b) Về việc gia hạn giấy phép lao động:
Theo quy định tại Nghị định số 102/2013/NĐ-CP ngày 05/9/2013 của Chính phủ quy định chi tiết thi hành một số điều của Bộ luật Lao động về lao động nước ngoài làm việc tại Việt Nam: Kể từ ngày 01/11/2013 (ngày Nghị định có hiệu lực thi hành) không còn thủ tục gia hạn giấy phép lao động cho người  lao động nước ngoài.

Lao động Trung Quốc ở Việt Nam: vấn đề hay cơ hội?


Tâm lý 'bài Hoa, kỳ thị' không hề có trong dân tộc Việt Nam, đó là ý kiến của một nhà văn hóa học trong cuộc tọa đàm trực tuyến hôm 04/9/2014, giữa các vị khách là các chuyên gia và nhà quan sát với BBC về hiện tượng số đông lao động và người di cư Trung Quốc tại Việt Nam. Từ Sài Gòn, nhà văn hóa học, Giáo sư Trần Ngọc Thêm nói:
"Tôi nghĩ rằng tâm lý bài Hoa, kỳ thị không hề có trong dân tộc của chúng ta," nhà nghiên cứu nói và điểm lại các giai đoạn tiếp xúc chính giữa người Hoa với Việt Nam từ lịch sử tới nay.
"Bây giờ cái người ta quan ngại là lao động phổ thông và các thương lái, thương lái rõ ràng, phần lớn là những người sang đây chui và làm ăn phần lớn không đường đường chính chính.
Thông thường dòng chảy lao động phổ thông là từ nước nghèo hơn đến nước có thu nhập cao hơn. Thế nhưng trong trường hợp này ở nước ta (Việt Nam) thì hơi bị ngược lại.

'Nghịch lý và lo ngại'
Giáo sư Thêm cho rằng đang tồn tại một nghịch lý và một điều đáng lo ngại đáng nói về dòng nhập cư người Trung Quốc vào Việt Nam.
Ông nói thêm: "Lực lượng thứ hai là các lao động phổ thông. Thông thường dòng chảy lao động phổ thông là từ nước nghèo hơn đến nước có thu nhập cao hơn. Thế nhưng trong trường hợp này ở nước ta thì hơi bị ngược lại. Trung Quốc thu nhập trung bình cao hơn của chúng ta.
"Nước đi thường người ta giải quyết công ăn việc làm cho dân chúng. Còn với nước đến, thường thường có nhu cầu, thông thường là nước có GDP (tổng thu nhập quốc nội) cao hơn, người ta thiếu lao động phổ thông là một.

'Thiếu lao động có tay nghề?'
Cho đến lúc này, hình như chưa có được một nghiên cứu nào đầy đủ để chỉ ra trình độ của người nhập cư lao động TQ vào VN là ở mức độ nào và cụ thể kỹ năng chuyên môn họ đạt được đến đâu

Khi được hỏi liệu Việt Nam có thực sự bắt buộc phải tuyển nhiều lao động Trung Quốc vì VN chưa có đủ lao động có tay nghề với trình độ phù hợp tại chỗ hay không, Tiến sỹ Trần Tuấn, chuyên gia đào tạo và chính sách cộng đồng nói:
"Đây là một thế giới phẳng, rõ ràng việc Trung Quốc thắng thầu, sau đó đưa đội ngũ nhân công của họ từ Trung Quốc sang Việt Nam để làm, câu trả lời liệu đội ngũ công nhân Trung Quốc này là loại đội ngũ lao động có nghề, có kỹ năng chuyên môn, có kiến thức chuyên môn thích hợp hay không, thì câu hỏi này phụ thuộc vào chính lãnh đạo các khu kinh tế đó đánh giá.
"Tôi cho rằng cho đến lúc này, hình như chưa có được một nghiên cứu nào để chỉ ra rằng là các trình độ của người nhập cư lao động Trung Quốc vào Việt Nam là ở mức độ như thế nào và cụ thể là các kỹ năng chuyên môn họ đạt được đến đâu.
"Thế còn nhận định của một lãnh đạo ở cấp tỉnh nói rằng ấy là những cán bộ cung cấp những kiến thức kỹ năng mà ở Việt Nam thiếu, thì tôi cho rằng đây là một nhận định có lẽ của một cá nhân. Chúng ta cần có một bài báo khách quan, một nghiên cứu khách quan để nêu ra những số liệu khách quan.

VN hàng năm vẫn đào tạo và xuất khẩu đội ngũ lao động 'có tay nghề' ra thị trường quốc tế.
"Điểm thứ hai, tôi cho rằng khi đưa lao động từ nước ngoài sang, các nhà kinh doanh, các nhà đầu tư luôn luôn nghĩ đến các vấn đề lợi nhuận kinh tế, cho nên chắc chắn rằng ở đây bài toán được đặt ra là liệu có thực sự Việt Nam không có được đôi ngũ nhân công đáp ứng các yêu cầu kỹ thuật đó hay không.
"Câu hỏi này là câu hỏi phải được trả lời và nhận định, và tôi cho rằng chúng ta có thể phỏng vấn trực tiếp các bộ phận liên quan vấn đề này. Còn vấn đề tay nghề và liên quan đào tạo người lao động, hiện nay chúng ta phải thấy rằng hiện nay ở Việt Nam thực sự chúng ta có được đội ngũ hàng năm kể cả trẻ, cũng như là đã ra trường, kể cả đội ngũ học đại học và các trường kỹ thuật và chúng ta hiện nay đang có một số lượng lớn.
"Và tôi cho rằng về khả năng học nghề và hệ thống trường nghề của chúng ta là có, tất nhiên để đáp ứng loại hình nghề như thế nào, thì nó phụ thuôc vào từng chuyên môn cụ thể, nhưng tôi cho rằng trước hết hạ tầng cơ sở của chúng ta là có, đội ngũ nhân lực để sẵn sàng đáp ứng việc học nghề là chúng ta có. Nhất là khi chúng ta đang dư thừa đội ngũ lao động sẵn sàng có thể đi làm ở các nước khác.

Có chính sách hạn chế nhập cư?
Được hỏi về chính sách, pháp luật quản lý, kiểm soát nhập cư đối với người nước ngoài, người lao động nước ngoài vào Việt Nam hiện nay, Phó Giáo sư Hoàng Ngọc Giao, chuyên gia về chính sách pháp luật nêu quan điểm:
"Ngay khi Việt Nam thực hiện chính sách mở cửa và mời gọi các nhà đầu tư nước ngoài vào Việt Nam, thì chính sách đối với việc sử dụng lao động người nước ngoài đã được thể hiện rất rõ ở trong luật đầu tư, cũng như ở trong luật lao động.
Nhiều bằng chứng là họ sống trong lòng dân cư VN trong các làng xã của VN, gây ra bất ổn, rất nhiều vấn đề có thể nói là những vấn đề xã hội, xung đột với người dân địa phương

"Và hiện nay trong pháp luật hiện hành ở Việt Nam, chính sách này đã tương đối đầy đủ và chặt chẽ, chính vì điều đó, khi xảy ra các hiện tượng như thông tin đại chúng đã đưa là lao động phổ thông của Trung Quốc vào (dự án) Bauxite Tây nguyên, lao động phổ thông của Trung Quốc vào những dự án lớn như Formosa, Vũng Áng, Hà Tĩnh, với tư cách người nghiên cứu chính sách và pháp luật, điều băn khoăn của tôi là vấn đề không phải ở chỗ chúng ta không đủ nguồn nhân lực để cung cấp cho các dự án.
"Mà vấn đề là trách nhiệm của chính quyền trong việc thực thi pháp luật nhự thế nào. Luật pháp của chúng ta (Việt Nam), ngay trong Nghị định năm số 102 năm 2013, Nghị định của Chính phủ hướng dẫn lao động liên quan người lao động nước ngoài làm việc ở Việt Nam đã có quy định rất rõ là các nhà thầu khi nộp hồ sơ thầu phải có nội dung yêu cầu liên quan đến vấn đề sử dụng lao động như thế nào.
"Trong đó chỉ được cho phép sử dụng những lao động có kỹ thuật cao mà người Việt Nam không thực hiện được và trong Nghị định này cũng nói rất rõ là nghiêm cấm các nhà thầu sử dụng lao động phổ thông để đưa vào các dự án, đấy là quy định của luật.
"Thứ hai, về mặt quản lý nhà nước, cũng quy định rất rõ là hàng quý, nhà thầu phải báo cáo với Ủy ban Nhân dân Tỉnh nơi dự án đó hoạt động, hàng nửa năm cũng như một quý, Sở Lao động cũng như Công an thanh tra kiểm soát việc sử dụng lao động.

Hồ sơ đề nghị gia hạn giấy phép lao động



a) Đối với người nước ngoài làm việc theo hình thức hợp đồng lao động, bao gồm:

- Đề nghị gia hạn giấy phép lao động cho người nước ngoài của người sử dụng lao động theo mẫu quy định của Bộ Lao động – Thương binh và Xã hội. Trong đó phải nêu rõ lý do chưa đào tạo được người Việt Nam để thay thế, họ tên những người Việt Nam đã và đang được đào tạo, kinh phí đào tạo, thời gian đào tạo, địa điểm đào tạo để thay thế người lao động nước ngoài;

- Bản sao hợp đồng lao động (có xác nhận của người sử dụng lao động);

- Giấy phép lao động đã được cấp.

b) Đối với người nước ngoài làm việc theo hình thức quy định tại điểm c và điểm d khoản 1 Điều 1 của Nghị định này, bao gồm: thủ tục làm giấy phép lao động mới

- Đề nghị gia hạn giấy phép lao động của đối tác phía Việt Nam theo mẫu quy định của Bộ Lao động – Thương binh và Xã hội;

- Bản sao hợp đồng ký kết giữa đối tác phía Việt Nam và phía nước ngoài;
